A proposal to amend the approved Conditional Use Permit, eliminating the convenience store with drive thru and fuels sales, to be replaced with a fast food drive-thru restaurant.  Also proposed is a reconfiguration the center and parking to accommodate 3750 square feet of additional retail uses.  The site is in the Neighborhood Commercial (C-1) zone at the southeast corner of Seventh Street and Ramona Expressway.

 

Pursuant to the CEQA process, the effect has been adequately analyzed in an earlier adopted mitigated negative declaration.  California Code of Regulations, Section 15063 ( c ) (3) (D).

 

6.0       NEW PUBLIC HEARINGS

 

            6.1       Specific Plan 1-04 (Villages at San Jacinto), Change of Zone Case 5-04, General Plan Amendment 5-04, Development Agreement, Tentative Tract Map 34081, and Environmental Impact Report

A master planned community known as The Villages at San Jacinto, consisting of 475.11 acres and located between Sanderson Avenue and Odell Avenue, south of Ramona Boulevard. The project features residential development for up to 1677 dwelling units, including detached single family units on lots ranging from 3,600 to 6000 square feet in size, attached and detached cluster homes, duplexes, and town homes within gated communities. Institutional uses consist of a high school and elementary school administration center on 47.9 acres, and a 12.2 acre elementary school. Recreational uses include 42.7 acres of parks, 22 acres of greenbelts, a 3 acre clubhouse, and 19 acres of lakes. Commercial uses consist of 33.5 acres of retail commercial and 13.5 acres of business-park.  The property has General Plan designations of Low Density Residential (LDR), Low Medium Density Residential (MDR), High Density Residential (HDR), Open Space (OS), and Community Commercial (CC).  The proposed zoning and general plan designation is Specific Plan. Tentative Tract Map 34081 will be heard concurrently to implement the specific plan to disclose the potential impacts.

 

An environmental initial study has been prepared for this project which has determined this project would have a significant impact on the environment.  Therefore, an Environmental Impact Report, together with an associated Mitigation Monitoring Program has been prepared.

           

            6.2       Amendment to Engineering Condition of Approval No. 19 for Vesting Tentative Tract 31097

A request to eliminate Engineering Condition of Approval No. 19 for Vesting Tentative Tract Map 31097; Engineering Condition of Approval No. 19 requires the developer to install a minimum of 30’ of new pavement along the proposed alignment of Lyon Avenue from De Anza to Ramona Expressway, including a traffic signal.  Vesting Tentative Tract Map 31097 is located at the northwest corner of Estrella Street and Palm Avenue, south of De Anza Drive.

 

Pursuant to the CEQA process, the effect has been adequately analyzed in an earlier adopted mitigated negative declaration.  (California Code of Regulations, Section 15063 (c) (3) (D)).   

 

            6.3       Large Family Day Care 07-01

A proposed home based child care facility for up to 12 children has received public opposition.  Per Article 4.07 or Ordinance 340 (Zoning Ordinance) the request has been forwarded to the Planning Commission for public consideration. The proposal will provide child care for up to 12 children between the hours of 6 a.m. and 10 p.m., Monday through Friday.

 

A large family day care is considered a Statutory Exemption pursuant to Section 15274 of the California Environmental Quality Act Guidelines.

 

      6.4       Zoning Ordinance Amendment 01-07 and Conditional Use Permit 4-06

A proposal for Amendments to Zoning Ordinance section 9.02 (C-1 Neighborhood Commercial Zone) height regulations and section 23.76 (Wireless Telecommunications Facilities) regulations to allow flexibility in height limitations for telecommunications base facilities for collocation of multiple service providers, and a Conditional Use Permit to construct a 45 ft. height stealth monopole (mono-elm) with antennas and equipment shelter within a 40 ft. x 30 ft. (1,200 sq. ft.) leased area on a 9-acre parcel located on the east side of Mountain Ave., north of Esplanade Ave.  The parcel (APN 547-130-008) is located in the C-1 Zone approx. 120 ft. from the planned future Ramona Expressway to the east. 

 

An environmental initial study has been conducted which has determined this project could have an impact on the environment; however, revisions have been made by or agreed to by the project proponent, and mitigation measures are proposed.  Therefore, a Mitigated Negative Declaration is recommended for adoption.  A subsequent hearing is required before the City Council following an action by the Planning Commission.  The probable date for a City Council hearing is on or after May 17, 2007.

 


6.5             Variance 2-07 for PM 33196

A proposal that would vary from the location, number and square footage requirements of the main and accessory wall sign for a business that has a gross floor area of less than 20,000 square feet.  The 14,820 square foot retail drug store at 2261 West Esplanade Avenue located at the northeast corner of Esplanade Avenue and Sanderson Avenue.

 

Section 3.07 of the Local Guidelines for Implementing CEQA exempts activities “where is can be seen with absolute certainty that there is no possibility that the activity in question may have a significant effect on the environment.”

 

6.6       Variance 3-07 for PM 33196

A proposed Variance to City sign regulations to allow additional signage for a coffee shop consisting of three wall signs, a freestanding menu board sign adjacent to a drive-through lane, and a small freestanding sign on a “clearance height” pole adjacent to the drive-through lane, located at 2281 W. Esplanade Avenue within a shopping center at the northeast corner of Esplanade Avenue and Sanderson Avenue.

 

Section 3.07 of the Local Guidelines for Implementing CEQA exempts activities “where is can be seen with absolute certainty that there is no possibility that the activity in question may have a significant effect on the environment.”

 

6.7       Variance 4-07 for Conditional Use Permit 4-05

A proposal that would vary from the square footage requirements of the main and accessory wall signs for a business that has a gross floor area over 20,000 square feet.  The 42,460 square foot retail supermarket located approximately 640 feet north of the Ramona Expressway on the east side of State Street at 1271 North State Street.
